1. Data controller
For the purposes of Turkish Personal Data Protection Law No. 6698 (“KVKK”), the data controller is SERGEN DEKORASYON YAPI İNŞ. SAN. TİC. LTD. ŞTİ. (the “Company” or “CASATEX”).
You may send requests relating to your personal data to info@casatex.com.tr.
2. Personal data and purposes of processing
When you contact us through the website’s Contact or Become a Partner forms, by email or through other communication channels, we may process the following data insofar as it is relevant to your enquiry:
- Identity and contact data: Name, email address and, if provided, telephone number.
- Professional and business information: Company or organisation name, country and business details included in your enquiry.
- Enquiry and communication data: Your message, product or partnership enquiry and related correspondence.
- Technical and security data: IP address, access records and server logs, where generated by the website’s technical systems.
We process this data to respond to enquiries, communicate with you, assess dealership or business partnership applications, take steps requested by you before entering into a possible business relationship, maintain information security, protect our rights in the event of disputes and comply with applicable legal obligations.
Please do not submit sensitive personal data unless it is necessary and specifically requested.
3. Legal bases
Depending on the specific processing activity, personal data may be processed under one or more of the legal bases set out in Article 5 of KVKK:
- Article 5(2)(c): Where processing is necessary to take steps, at your request, before entering into a contract.
- Article 5(2)(f): Where processing is necessary for the Company’s legitimate interests, such as handling enquiries or protecting system security, provided that your fundamental rights and freedoms are not prejudiced.
- Article 5(2)(e): Where processing is necessary for the establishment, exercise or protection of a right.
- Article 5(2)(ç): Where processing is necessary for compliance with a legal obligation.
The applicable legal basis depends on the actual purpose and circumstances of the processing. Where consent is legally required, it will be requested separately.
4. Recipients of personal data
To the extent necessary for the purposes described above, your data may be disclosed to:
- Authorised Company personnel;
- Website hosting, IT infrastructure, technical support, communication and information-security service providers;
- Analytics and advertising providers, such as Google Analytics and Google Ads, subject to your cookie choices and applicable legal requirements;
- Competent public authorities, institutions or judicial bodies where disclosure is required by law or necessary to protect a legal right.
5. International transfers
Our website is hosted on the infrastructure of Hetzner Online GmbH, whose servers are located in Germany. We also use Google services for email communication and, subject to your cookie choices, for analytics. As a result, your personal data may be stored or processed on servers located outside Türkiye.
Personal data is transferred abroad in accordance with the conditions and safeguards set out in Article 9 of KVKK.
6. Retention and deletion
Personal data is retained for as long as necessary for the purposes for which it was collected and for any applicable statutory retention or limitation periods. When the purpose ends and no other legal basis for retention remains, the data will be deleted, destroyed or anonymised in accordance with applicable law.
7. Your rights
Subject to Article 11 of KVKK, you may apply to the Company to learn whether your personal data is processed, request information about such processing, learn its purposes and whether the data is used in accordance with those purposes, identify third parties to whom it has been disclosed, request correction of incomplete or inaccurate data, request deletion or destruction where the legal conditions are met, request notification of such actions to relevant recipients, object to an adverse result arising exclusively from automated analysis and seek compensation for damage caused by unlawful processing.
You may submit your request to info@casatex.com.tr, using a method that permits identity verification and complies with applicable requirements. Requests will be handled within the periods and procedures prescribed by law.
8. Updates
This notice may be updated to reflect changes in applicable law or the Company’s data-processing activities. The latest version will be published on our website.
